These Terms & Conditions govern the use of the website casadaeiracaramulo.pt and the booking and use of Casa da Eira’s local accommodation properties. By making a booking, the guest confirms that they have read and accepted these Terms.
Identification
The properties are operated by Manuel Fernandes Dias, tax number 192182552, with tax domicile at Albitelhe, Calçada da Póvoa, Travessa do Cabeço n.º 9, 3670-054 Campia, Portugal, as holder of the Local Accommodation (Alojamento Local) registered under number(s) 173959/AL (Caramulo), 174230/AL (Campia).
Scope
Casa da Eira offers holiday homes under the Local Accommodation (Alojamento Local) regime in Caramulo (Serra do Caramulo) and Campia (Vouzela), Portugal. The features of each property, its maximum occupancy and amenities are described on the website.
Bookings
Bookings can be made directly (through the website, email or phone) or through partner booking platforms (Booking.com, Airbnb).
A booking is considered confirmed once accepted by Casa da Eira and, in the case of direct bookings, once the stated deposit has been paid. Bookings made through platforms are additionally governed by those platforms’ terms.
Prices, fees and taxes
Prices are shown in euros (€) and include VAT at the legal rate applicable to accommodation (currently 6%). Additional charges may apply, such as a cleaning fee or municipal tourist tax where applicable; these are indicated before the booking is confirmed.
Payment
For direct bookings, a deposit of 50% of the total is requested to confirm the booking, with the remaining 50% due by the check-in date.
The following payment methods are accepted: bank transfer and MB WAY. For bookings made through platforms, payment is processed by the relevant platform.
Cancellation and no-show
Direct bookings: the 50% deposit is non-refundable. There is no free cancellation on direct bookings — if you cancel, the deposit already paid is not refunded.
Bookings through Booking.com or other platforms: the cancellation conditions of the relevant platform apply, as stated at the time of booking (for example, 14 days of free cancellation).
In the event of a no-show without notice, the full booking amount is due.
Check-in, check-out and guest registration
Check-in is available from 4:00 PM and check-out must be completed by 1:00 PM. Different times may be agreed subject to availability and prior request.
Check-in is by self check-in, with an access code sent before arrival, once approved. For this reason, we ask that you complete the online check-in in advance.
By legal requirement, all guests (including foreign nationals) must be registered. A valid identification document will be requested, the data of which is reported to the competent authorities (SEF/AIMA) as required by law.
The number of guests may not exceed the maximum occupancy indicated for each property.
House rules
- Parties and events are not allowed at the properties;
- Smoking is prohibited inside the properties; smoking is allowed in outdoor areas, using the ashtrays provided;
- The peace of the neighbourhood must be respected, in particular the quiet hours after 10:00 PM;
- Pets are accepted with prior notice; an additional cleaning fee may apply;
- The pool (at the Caramulo properties) is not fenced. Its use is entirely at the guests’ own responsibility and children must always be supervised by an adult.
Guest responsibility
The guest undertakes to use the properties with care and is responsible for any damage caused during the stay, whether by themselves or by their companions and visitors. Any damage or malfunction must be reported to Casa da Eira immediately.
Limitation of liability
Casa da Eira is not liable for loss, theft or damage to guests’ personal belongings, nor for damage resulting from improper use of the facilities, in particular the pool and equipment. The use of the amenities is at the guest’s own risk.
In any event, our liability is limited to the value of the booking, except where the law provides otherwise.
Force majeure
Casa da Eira is not liable for failure to perform its obligations resulting from force majeure circumstances beyond its reasonable control (for example, natural disasters, government restrictions or serious infrastructure failures).
Data protection
The processing of guests’ personal data is governed by our Privacy Policy, available on the website.
Complaints Book and Alternative Dispute Resolution
Casa da Eira provides a Complaints Book, including its electronic version, accessible at www.livroreclamacoes.pt.
Under Portuguese Law no. 144/2015 of 8 September, in the event of a consumer dispute the consumer may turn to an alternative dispute resolution entity. The competent entity is the National Centre for Consumer Dispute Information and Arbitration (CNIACC — www.cniacc.pt). The European Online Dispute Resolution platform is also available at ec.europa.eu/consumers/odr. More information at www.consumidor.gov.pt.
Governing law and jurisdiction
These Terms are governed by Portuguese law. The courts of the district where the property is located have jurisdiction over any dispute, without prejudice to mandatory consumer protection rules.
Changes
Casa da Eira reserves the right to amend these Terms & Conditions. The applicable version is the one in force at the date of the booking.
